MEMPHIS, TN (WMC) – Two men have been indicted in the murder and attempted robbery that resulted in a man’s body being left undiscovered in a van for 49 days.

Police say 19-year-old Mardracus West and Earl Brown, 21, opened fire on two men as they sat inside their van at Yale Avenue on Dec. 18, 2017.

Seven weeks later, when the victims went to get their van from the impound, the body of Bardomiano Perez Hernandez, was found behind the front seat.

West and Brown are charged with first-degree murder in the perpetration of attempted especially aggravated robbery, and attempted especially aggravated robbery. West is also charged with two counts of attempted first-degree murder of two other victims and employment of a firearm in the commission of a dangerous felony.

The autopsy shows that Hernandez was shot with a single bullet. The bullet hit his stomach, pancreas, and a major vein.

Former Attorney Aaron Neglia said evidence shows Perez Hernandez could have survived his injuries if police officers had noticed him and taken him to the hospital.

At this point, no disciplinary action has been taken against any city employees. Memphis police said the case is still under investigation.
